Can you legally adopt a stepson who is 17 with out the biological mothers consent?

I have been married to his biological father for 14 years and his father got legal custody 13 years. I have raised him since then. His mother still lives in the same town but he does not go over and see her. She hasnt paid child support in 12 years and has nothing to do with him
